Terms of Use

1. Acceptance of Terms

By accessing or using the DayDayDress mobile application (the "App") and related services (collectively, the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you must not use the Service.

These Terms constitute a legally binding agreement between you and DayDayDress ("we", "us", or "our"), a company incorporated in Hong Kong SAR.

2. Service Description

DayDayDress is an AI-powered virtual wardrobe and try-on application. The Service provides:

  • Virtual try-on — AI-generated images showing how garments may look on you
  • Wardrobe management — tools to photograph, categorize, and organise your clothing items
  • Daily outfit suggestions — AI-curated outfit recommendations based on your wardrobe, preferences, and weather
  • AI categorization — automatic detection of garment attributes from photographs

3. Eligibility

You must be at least 16 years of age to use the Service. By creating an account, you represent and warrant that you meet this age requirement. If you are between 16 and 18 years old (or the age of majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

4. Account Responsibilities

To use the Service, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security and confidentiality of your login credentials
  • Promptly notify us of any unauthorised use of your account
  • Accept responsibility for all activities that occur under your account

You may not create multiple accounts or share your account credentials with others.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not:

  • Upload photographs of other people without their explicit consent
  • Upload content that is illegal, obscene, defamatory, threatening, or otherwise objectionable
  • Upload content that infringes the intellectual property rights of any third party
  • Attempt to reverse-engineer, decompile, or extract the AI models or algorithms used by the Service
  • Use automated tools (bots, scrapers, etc.) to access or interact with the Service
  • Circumvent rate limits, usage quotas, or other technical restrictions
  • Use the Service to generate content for commercial purposes without our prior written consent
  • Interfere with or disrupt the integrity or performance of the Service

6. Subscriptions and Billing

6.1 Plans

The Service offers the following plans:

  • Free — 10 virtual try-ons, 7 days of daily suggestions, 20 AI categorizations, and unlimited wardrobe storage
  • Pro ($4.99 USD per month) — 30 virtual try-ons per month, daily outfit suggestions, unlimited AI categorization, and priority generation

We reserve the right to modify plan features and pricing. Any changes will be communicated in advance and will not affect your current billing period.

6.2 Billing

Subscriptions are billed through Apple App Store (for iOS) or Google Play Store (for Android) via our payment partner RevenueCat. Payment terms, refund policies, and billing cycles are governed by the respective platform's terms of service.

6.3 Auto-Renewal and Cancellation

Pro subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You can cancel your subscription at any time through your device's subscription management settings (Apple App Store or Google Play Store). Cancellation takes effect at the end of the current billing period; you will retain access to Pro features until then.

6.4 Refunds

Refunds are governed by the policies of Apple App Store or Google Play Store, as applicable. Please contact the relevant platform for refund requests.

7. Intellectual Property

7.1 Your Content

You retain ownership of all photographs and content you upload to the Service ("User Content"). By uploading User Content, you grant DayDayDress a non-exclusive, worldwide, royalty-free licence to use, process, store, and display your User Content solely for the purpose of providing and improving the Service.

7.2 AI-Generated Content

Virtual try-on images and other AI-generated outputs ("AI Content") are created using your User Content and our technology. You are granted a personal, non-exclusive, non-transferable licence to use AI Content for your own personal, non-commercial purposes. You may not sell, sublicence, or commercially exploit AI Content without our prior written consent.

7.3 Our Intellectual Property

The Service, including its design, code, AI models, algorithms, branding, trademarks, and all other intellectual property, is owned by DayDayDress and protected by applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in our intellectual property except as expressly stated.

8. AI-Generated Content Disclaimer

Virtual try-on results and AI-generated suggestions are approximations created by artificial intelligence. They are provided for informational and entertainment purposes only. We do not guarantee:

  • Accuracy of colour representation in generated images
  • Accuracy of fit, sizing, or proportions
  • Suitability of suggested outfit combinations
  • That results will match the appearance of actual physical garments

AI-generated content is not a substitute for physically trying on garments. You acknowledge that results may vary and should not be solely relied upon for purchasing or wardrobe decisions.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. By using the Service, you consent to the data practices described in the Privacy Policy.

10. Service Availability

We strive to provide continuous access to the Service but do not guarantee uninterrupted or error-free availability. The Service may be temporarily unavailable due to:

  • Scheduled maintenance or updates
  • Unexpected technical issues or outages
  • Factors beyond our reasonable control (force majeure)

We will make reasonable efforts to notify you of planned maintenance in advance.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied
  • We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Our total aggregate liability for any claims arising out of or related to the Service shall not exceed the total fees you have paid to us in the 12 months preceding the claim
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or business interruption

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be lawfully excluded.

12. Indemnification

You agree to indemnify, defend, and hold harmless DayDayDress, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:

  • Your use of the Service
  • Your User Content
  • Your violation of these Terms
  • Your violation of any third-party rights

13. Termination

By you: You may terminate your account at any time by deleting it through the App's Privacy & Data settings or by contacting us at [email protected].

By us: We may suspend or terminate your account if you violate these Terms, engage in fraudulent or abusive behaviour, or if we are required to do so by law. We will provide reasonable notice where practicable.

Upon termination, your right to use the Service ceases immediately. Data deletion is handled in accordance with our Privacy Policy.

14. Modifications to These Terms

We may revise these Terms from time to time. When we make material changes, we will notify you through the App and, where we have your email address, via email. The revised Terms will take effect on the date stated at the top of the document.

Your continued use of the Service after the revised Terms take effect constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service and delete your account.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without regard to its conflict of law provisions.

Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Hong Kong SAR.

Before initiating any formal legal proceedings, you agree to first attempt to resolve the dispute informally by contacting us at [email protected]. We will attempt to resolve the matter within 30 days.

16. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.
